Felony Assault With A Deadly Weapon Charges Dropped to a Misdemeanor at Preliminary Hearing On June 12, 2025
Our client, Igriselda, was charged with PC 245(a)(1), Assault With a Deadly Weapon which was a strike offense. On June 12, 2025, we had the preliminary hearing in this matter where we cross-examined the arresting officer and challenged the sufficiency of the evidence. We also requested that the Court reduce her offense to a misdemeanor and argued that it would be in the best interest of justice should the felony charge be reduced to a misdemeanor. The court agreed to the reduction and the life-changing felony was reduced to a misdemeanor. By reducing her offense to a misdemeanor, our client is now statutorily eligible for judicial diversion which will allow her to get her misdemeanor charge dismissed in exchange for community service and anger management classes.
The moral of this story is that sometimes with even the most difficult cases (strike offenses), there is hope if the case is strategically defended properly.
