Felony Strike Charges Dismissed. Client pleads to a Misdemeanor on 9/18/25
Our client, David, was involved in an incident which got him arrested. The prosecution wanted significant jail time for his offense. He had no prior record. The prosecution’s opening offer to resolve the case was for our client to plead to the strike offense and go to county jail for 364 days. We rejected that offer. Once we rejected the offer, the prosecution increased their offer to 2 years in prison. The defendant was charged with PC 245(a)(1), assault with a deadly weapon. This offense is not only a strike but it would lead to a mandatory revocation of our client’s driver’s license. We set the case for preliminary hearing and before that hearing started, we were able to get the charges reduced to a misdemeanor WITH NO JAIL TIME and NO COMMUNITY SERVICE. Our client has to do 56 AA meetings and 26 Anger Management classes.
At Kia Law Firm, we strive to make a difference in all of our client’s lives. By pleading to a misdemeanor, he is not a convicted felon, did no jail time and avoided the harsh consequences of losing his California Driver’s License for lifetime.
