Felony Assault Charge Reduced to Misdemeanor and Then Reduced to an Infraction
Our client, Aurek, was arrested for Assault with a Deadly Weapon in violation of PC 245(a)(4). We always believed in the innocence of our client. We had a total of 14 court appearances defending our client. We rejected the prosecutor’s initial felony offer. We set the case for preliminary hearing. Eventually, on March 10, 2026, we had our preliminary hearing in this matter. At that hearing, we requested that the Court reduce the felony offense to a misdemeanor. At the conclusion of that hearing, the Court agreed and made the case a misdemeanor and sent us to a new misdemeanor courtroom downstairs. We litigated the misdemeanor case and we were then offered the chance to plead to a misdemeanor. We rejected that proposed disposition. Eventually, the case was set for trial. On the date the case was set for trial, we were offered an infraction of disturbing the peace (PC 415(2)) with a $205 fine. Our client agreed to that proposed plea on June 24, 2026. He is not on probation and only accepted a plea deal to an infraction to bring closure to his journey.
